Artiststore is a platform built to empower artists and creators. We value originality, creativity, and respect for the rights of others. When uploading content to Artiststore, you must ensure that all works are your own original creations and do not infringe on the intellectual property or publicity rights of any third party.

Using someone else’s work without permission, or presenting it as your own, is not only against our policies but may also violate applicable laws.

Understanding Intellectual Property Rights

A Note on Fair Use

In some limited cases, you may be allowed to use copyrighted or trademarked material under “fair use” or similar legal doctrines. However:

Even if you believe your use qualifies as fair use, you are solely responsible for ensuring your content complies with applicable laws. Artiststore may remove content if we receive a valid complaint or otherwise become aware of potential infringement.

Your Responsibility

You are fully responsible for all content you upload, display, or sell through Artiststore. By using the platform, you agree to comply with our User Agreement and all applicable laws.

If you use any content (including images, logos, text, or likenesses) that belongs to another individual or entity, you must obtain proper authorization before using it.

Content Visibility and Removal

Content that violates our policies or is subject to a valid complaint may be removed or made unavailable on the platform.

Content that is not publicly displayed cannot be discovered by users and will not be available for sale.

Repeat Infringer Policy

Artiststore takes intellectual property rights seriously. Accounts that repeatedly violate our policies—including the User Agreement or this IP Policy—may be subject to actions such as:

Notice and Takedown Procedure

If you believe that your intellectual property or publicity rights have been infringed, you may submit a complaint to Artiststore.

Your notice should include:

  1. A physical or electronic signature of the rights holder or authorized representative
  2. A description of the work claimed to be infringed
  3. A description of where the infringing content is located on the platform (e.g., URL)
  4. Your contact information (name, address, email, phone number)
  5. A statement that you have a good faith belief that the use is not authorized
  6. A statement, under penalty of perjury, that the information provided is accurate and that you are authorized to act on behalf of the rights holder

Artiststore will review and process valid complaints in accordance with applicable laws.

If Your Content Has Been Removed

If you believe the removal was made in error, you may submit a counter-notification.

Counter-Notification

If you believe your content was removed by mistake or misidentification, you may submit a counter-notice including:

  1. Your signature (physical or electronic)
  2. Identification of the removed content and its original location
  3. Your contact information
  4. A statement that you believe the removal was a mistake or misidentification
  5. A statement that you consent to applicable legal jurisdiction and process
  6. Artiststore may forward your counter-notice to the original complainant. If no legal action is taken within a reasonable period, and your content complies with our policies, it may be reinstated.
